Over the next six months, two privacy laws will go into effect – Nevada this month (October 1st) and California on January 1st – where fines can exceed $5,000 per website visitor.
Approximately ten other states have proposed similar (but not the same) laws. Some of these bills, if passed, would allow consumers to sue businesses anywhere in the US for not having a compliant Privacy Policy. This requires not only a Privacy Policy, but continuous updates as well based on the laws of each state.
Manufacturers receive inquiries via website from all over the US, for this reason they need to consider a strategy to keep their policies compliant with each of these state-specific privacy laws. Also, larger manufacturers expect their vendors to have data privacy standards in place so their own audits are more seamless.
To be proactive about this issue, we’ve partnered with a company that offers a Privacy Policy generator. They are the only generator listed as a trusted vendor with the International Association of Privacy Professionals (iapp.org) and their compliance guides have been downloaded by companies like GE. The key feature of this program is that it will automatically update your website policies when the laws change, at a fraction of the cost of an attorney.
If you have a privacy attorney in place, wonderful. However, if you do not have a strategy to keep your website policies up to date, reply to this email and I will provide you with a link to obtain a license so that you can get protected for only $99/year.
